You would be amazed at the number of people out there just going about their daily lives who have warrants out for their arrest. Any time, day or night, they can be arrested and taken into custody no matter where they are.
There are two types of warrants out there that courts issue. The first is a bench warrant. These are issued when you miss a court date and the judge issues it right from their bench. This warrant could go on your permanent record as an FTA (failure to appear). A judge can also issue a bench warrant if you’re already convicted and on probation but fail to show proof of progress completion on whatever punishment was given.
The other type of warrant is much more common. An arrest warrant is usually issued in response to an officer’s sworn affidavit or declaration that you committed a crime and probable cause exists. If you committed a crime and think you’ve gotten away with it, you could be in for a surprise when the arresting officer comes knocking. That’s the other shoe dropping. It’s only a matter of time before you’re picked up at home, at work, or in your car.
How do you know if you have a warrant out? We can help with that. Our office can call the courthouse and ask the criminal operations clerk to run a county-wide search of any pending warrants and court proceedings. We will also search the court’s website to see if there is any info regarding any pending proceedings, including those where a bench or arrest warrant has been issued.
If you think you might fall into one of these categories, don’t wait for the other shoe to drop. We can immediately start searching and make sure that if you do have a warrant out for your arrest, it is terminated immediately. Then we can fight the underlying case that led to it.
If you or anyone you know needs help or isn’t quite sure if they have an outstanding warrant or not, give us a call or send us an email. Mistakes happen—jail doesn’t have to. We look forward to hearing from you soon.
