You’re still waiting to hear back about an interview you attended a couple of weeks ago. You’re desperately hoping you will get the job.
Before they would consider you for employment, the employer wanted to run a criminal background check on you. After this long wait, you can’t help but think that maybe there was something on the report that caused the employer to not to hire you. You want to find out for yourself, but you don’t know how to get a copy of your background check report.
The Fair Credit Reporting Act (FCRA) regulates background checks and credit reports. It guarantees you access to a background check that is being used against you in the employment process.
There are three ways you can get ahold of a report being used in your employment application.
The first way is to receive it directly from the background check company. If a report has adverse information on it, such as convictions, and it has not been recently updated, the background check company is required to issue you a copy before they issue one to the employer.
The second way to receive the report is from the employer. If the employer receives a background check and plans to use the information on it to take adverse action against you, they’re also required to provide you with a copy prior to taking any action against you.
The third way to obtain a copy of your report is by directly requesting a copy from the background check company. The Fair Credit Reporting Act states that a company that maintains records on you must give you a copy of the report for free once a year, upon request. Watch the video to learn more.
